New NYC Parapet Inspection Requirement

In July 2023, the NYC Department of Buildings (DOB) introduced a new rule requiring annual inspections of building parapets, specifically for those facing public rights of way. Inspections must begin by January 1, 2024, and reports are due by December 31, 2024.

Key Points to Remember:

  1. Annual Inspections: Buildings with parapets adjacent to public rights of way must be inspected by a competent person to inspect parapets.
  2. Compliance Deadline: Start your inspections in early 2024 to ensure the final report is completed by the end of the year.
  3. FISP Clarification: This new requirement is separate from the Façade Inspection & Safety Program (FISP). Filing a FISP report alone does not necessarily fulfill the parapet inspection obligation if the FISP report does not include all information required by the parapet inspection (RCNY 103-15).
  4. Documentation: While reports do not need to be submitted to the DOB, Owners must maintain the observation reports for at least six (6) years and must make such reports available to the department upon request. We recommend maintaining a separate report for parapets for clarity and consistency purposes.
